1. Changes to the Terms

We may modify these Terms at any time in our sole discretion. Updates will be posted on the Platform. Continued use after changes constitutes acceptance. If you do not agree to the updated Terms, your only remedy is to stop using the Platform.

2. Eligibility

You must be at least 18 years old to access or use the Platform. By using the Platform, you represent and warrant that you meet this requirement.

3. Right to Access and Use the Platform

Subject to these Terms, Attack Capital grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for lawful business, informational, and evaluation purposes.

• Reverse engineer, decompile, or attempt to extract source code
• Copy, modify, distribute, sell, or sublicense the Platform
• Use the Platform to build or benchmark a competing product
• Scrape, crawl, or harvest data using automated tools
• Circumvent security or access controls
• Introduce malware or harmful code
• Use the Platform in violation of applicable laws

We reserve the right to suspend or terminate access at any time.

4. Accounts and Authorized Users

Certain features may require account registration. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

You agree to notify us immediately of any unauthorized access or use.

5. Trials, Demos, and Early Access

We may offer free trials, demos, reports, or early access to products or tools. These are provided solely for evaluation purposes.

During trial or preview periods:

• No warranties or support obligations apply
• Use is at your own risk
• We may terminate access at any time

6. Use of Information

Your use of the Platform may involve submitting personal or business information. Our collection and use of such information is governed by our Privacy Policy, which is incorporated by reference.

7. Ownership and Intellectual Property

The Platform and all associated content, including text, graphics, logos, reports, software, and tools ("Content"), are owned by or licensed to Attack Capital and protected by intellectual property laws.

You may not reproduce, distribute, modify, or publicly display Content without prior written permission.

All Attack Capital trademarks, logos, and branding are the exclusive property of Attack Capital.

You retain ownership of any information you submit. By submitting data, you grant us a worldwide, royalty-free license to use it for operating, improving, and promoting the Platform.

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without restriction or compensation.

9. Platform Rules

You agree not to use the Platform to:

• Violate any law or regulation
• Infringe intellectual property rights
• Transmit false, misleading, defamatory, or harmful content
• Impersonate another person or entity
• Interfere with Platform operations or infrastructure

10. No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, error-free, or secure operation.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES
• TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PRIOR THREE (3) MONTHS, WHICHEVER IS GREATER

The Platform may contain links to third-party websites. We are not responsible for their content, accuracy, or practices. Accessing third-party sites is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Attack Capital and its affiliates from any claims arising out of your misuse of the Platform or violation of these Terms.

14. Termination

We may suspend or terminate your access at any time without notice. Upon termination, your right to use the Platform immediately ceases.

Sections relating to IP, liability, indemnification, arbitration, and governing law survive termination.

15. Arbitration and Class Action Waiver

Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act.

You waive the right to participate in class actions or representative proceedings.

Arbitration will be conducted on an individual basis only.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Miscellaneous

• These Terms constitute the entire agreement between you and Attack Capital
• You may not assign your rights without our consent
• Failure to enforce any provision is not a waiver
